Release and Waiver of Liability and Indemnity Agreement.
(Read Carefully)
In consideration of being permitted to participate in any way in the Martial Arts Program of Chen Style Taijiquan (the “Program”) presented in Tempe, AZ during the period from ______ and/or being permitted to enter for any purpose any restricted area (herein defined as any area to which admittance is prohibited to the general public) in connection therewith, the person participating in the Program and, if said Participant is a minor in the State where the Martial Arts program is held, then also his or her parent or legal guardian (each, individually, a “Participant” for purposes of this Agreement) agree:
1. The Participant will, prior to participating in the below martial arts activity or event, inspect the facilities and equipment to be used, and that if the Participant believes anything is unsafe, they will immediately advise the officials of such condition and said Participant or minor Participant should refuse to participate in the Martial Arts Program. Participant further understands and agrees that if, at any time, a Participant feels that anything in the Marital Arts Program or the premises in which the said Program is believed to be UNSAFE, they will immediately take all precautions to avoid the unsafe area and REFUSE TO PARTICIPATE further.
2. Participant acknowledges that:
(a) THE ACTIVITIES OF THE EVENT(S) ARE VERY DANGEROUS;
(b) There are risks and dangers associated with participation in martial arts events and activities which could result in bodily injury partial and/or total disability, paralysis and death;
(c) The social and economic losses and/or damages, which could result from these risks and dangers described above, could be severe;
(d) These risks and dangers may be caused by the action, inaction or negligence of the Participant or the action, inaction or negligence of others, including, but not limited to, the Releasees named below;
(e) there may be other risks not known or reasonably foreseeable at the time of signing this Agreement; and
(f) any injuries received may be compounded or increased by negligent rescue operations or response procedures of the Releasees.
3. Participants accept and assume such risks, whether known or unknown, and responsibility for the losses and/or damages following such injury, disability, paralysis or death, however caused and whether caused in whole or in part by the negligence of the Releasees named below.
4. Participants, for themselves and for their personal representatives, assigns, executors, heirs and next of kin HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the Chen Xiaowang World Taijiquan Association, the instructors involved in conducting the martial arts event or program, the facility used by the Participant, including its owners, managers, promoters, lessees of premises used to conduct the martial arts event or program, the premises and event inspectors, underwriters, consultants and others who give recommendations, directions, or instructions to engage in risk evaluation or loss control activities regarding the martial arts facility or events held at such facility and each of them, their directors, officers, agents, employees (referred to herein collectively and individually as “Releasee”) FROM ALL LIABILITY TO THE PARTICIPANT FOR ANY AND ALL CLAIMS, DEMANDS, LOSSES OR DAMAGES AND ANY CLAIMS OR DEMANDS THEREFORE ON ACCOUNT OF ANY INJURY, INCLUDING BUT NOT LIMITED TO THE DEATH OF THE PARTICIPANT OR DAMAGE TO PROPERTY, ARISING OUT OF OR RELATING TO THE EVENT(S) CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEE OR OTHERWISE.
5. EACH PARTICIPANT further expressly agrees that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the Province or State in which the event is conducted and that if any portion of this agreement is held invalid, it is agreed that the balance shall, notwithstanding continue in full legal force and effect.
6. The Participant and/or the parent(s) and/or legal guardian(s) for the minor participant are executing this Release and Waiver of Liability and Indemnity Agreement with the express agreement and understanding that If, despite this Release, the Participant or minor Participant makes a claim against any of the Releasees, the Participant and/or the parent(s) and/or legal guardian(s) of the minor Participant will be liable to the Releasees named or described herein for any money which Releasees have paid or are ordered to pay to the Participant or the legal representative of the Minor Participant or on his behalf or for his benefit, and shall hold Releasees harmless to the extent of any such award, plus Releasees legal fees and expenses in defending against such a claim.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT FULLY, UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY REGISTERING, AND HAVE REGISTERED FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TΟ ΜΕ, AND INTEND MY REGISTRATION IN THE EVENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
